الأحوال ألا یزید مجموع الغرامات على 10 % من اجمالي قیمة العقد، ویفرض الطرف الأول الغرامة على الطرف الثاني بمجرد حدوث
التأخیر، ودون الحاجة لانذاره أو اتخاذ أي إجراءات قضائیة، أو إلى اثبات الضرر الواقع على الطرف الأول، والذي یعتبر متحققا حكما بمجرد التأخیر.
