يسترجع الخاضع للضريبة التأمين في حال صدور قرار مجلس شورى الدولة كلياً لصالحه. وفي حال كان القرار المذكور كلياً لصالح الخزينة يصبح التأمين المذكور حقاً للخزينة . أما إذا جاء القرار جزئياً لمصلحة الخاضع للضريبة فيكون التأمين الجائز ردّه بنسبة الضريبة التي قضى الحكم بعدم توجبها عليه
