يعتبر عقد العمل سارياً ومنتجاً لجميع الآثار المترتبة عليه من تاريخ مباشرة العامل الفعلية للعمل ولا تدخل في حساب فترة التجربة إجازة عيد الفطر و عيد الأضحى والإجازة المرضية .
