و عن الاسباب الثاني و الثالث و الرابع و مؤداها تخطئة المحكمة بالنتيجة التى توصلت إليها بالرغم من ان فرض عوائد التنظيم الخاصة وفقا لأحكام المادة 52 من قانون تنظيم المدن و القرى و ان المميز ضدهما اقرا بصحة المديونية و هي عوائد التنظيم المفروضة، و بذلك يكون ما توصلت إليه المحكمة من ان المبلغ المدعى به قد تم فرضه نتيجة تغيير صفة الاستعمال كان دون وجود دليل على ذلك
