بالإشارة إلى خطابكم الخاص بالمذكرة التى ارسلتها البعثة الدائمة لدى الأمم المتحدة فى جينيف والتى وردت من المفوضية السامية لحقوق الإنسان مشيرة الى قرار الجمعية العامة لحقوق الإنسان المعنون " نداء عالمي للعمل الملموس للقضاء على العنصرية والتمييز العنصري وكره الأجانب وصور عدم التسامح ذات الصلة والتطبيق الشامل ومتابعة إعلان ديربان".
وبالإشارة إلى طلب موافاتكم بالمعلومات التى تخص إسهامات مصر وأحدث الإجراءات التى جرى إتخاذها لمكافحة العنصرية والتمييز العنصرى وكراهية الأجانب وصور عدم التسامح ذات الصلة.
يود المجلس إحاطتكم بما يلى:
أن الدستور المصرى 2014 قد نص فى مدته 53 على إنشاء مفوضية مستقلة يكون من شأنها إتخاذ كافة التدابير اللازمة للقضاء على كافة أشكال التمييز، كما جرم فى نفس المادة التمييز والحض على الكراهية بذكرها جريمة يعاقب عليها القانون وأكدت نفس المادة على المساواه بين المواطنين.
كما ان المحكمة الدستورية العليا والعديد من الأحكام القضائية سبق وأن حظرت التمييز بين المواطنين على أساس الجنس أو الأصل أو اللغة أو الدين أو العقيدة أو المكانة الإجتماعية والآراء السياسية أة الإعاقة أو الإعتقاد.
وفيما يخص جهود المجلس القومى لحقوق الإنسان فإن مشروع مكافحة التمييز وتكافؤ الفرص والمساواه بين المواطنين مشروع قديم للمجلس ، ففى مؤتمر المواطنة 2007 سبق وأن تم تقديمه إلى أن اصبح إلزاماً دستورياً.
وفى هذا الصدد عقد المجلس ورشة عمل فى 25 نوفمبر 2014 تحت عنوان "مشروع إصدار قانون تكافؤ الفرص وحظر التمييز وإنشاء مفوضية لهذا الغرض فى ضوء المادة 53 من الدستور" حيث تم عرض
