و قد استقر اجتهاد محكمة التمييز الموقرة بشأن تطبيق احكام المادة 52 من قانون تنظيم المدن و القرى و الابنية على ان عدم مراعاة الشروط الشكلية في القرار الصادر بفرض عوائد التنظيم و كذلك عدم تحديد القرار للغاية من فرض عوائد التنظيم و اوجه انفاق هذه العوائد ضمن اوجه الانفاق المحددة في الفقرة 4 من المادة 52
