7/3 يحق لـ "مدن" تطبيق الشرط الجزائي (ريالين للمتر المربع شهريا)، على المساحات الفضاء في الأرض المؤجرة، التي لم يتم استغلالها من "المستأجر" طبقاً للمخططات الهندسية المعتمدة من "مدن"، مع بقاء حق "مدن" المطلق في أن تقوم باسترجاع هذه المساحات وإعادة تأجيرها للغير، دون أي تعويض للمستأجر ودون اعتراض منه.
