وبالرغم مما سبق، يحق للمدير، حسبما يراه مناسباً وفق لتقديره المطلق، أن يمتنع عن قبول التعليمات المتعلقة بحساب الاستثمار و/ أو عن دفع أي مبلغ إلى أن يتسلم المدير بصيغة مقنعة له مثل أمر محكمة أو وكالة شرعية أو إثبات آخر مقنع للمدير بالنسبة لصلاحية أي من الورثة، منفذي الوصايا، مديري التركة، الممثلين الشخصيين، الأمناء أو الخلفاء بالتعامل مع حساب الاستثمار.
