انه يقتضي رد طلب وقف التنفيذ لعدم توافر شروطه المنصوص عليها في المادة 77 من نظام مجلس شورى الدولة، ذلك ان ادلاءات المستأنفة خالفت النصوص القانونية النافذة، و ان متابعة تنفيذ القرار المطعون فيه لا تؤدي إلى حدوث ضرر بليغ لا يمكن تعويضه بالنسبة للدولة لأن الشركة مقيمة في لبنان و قادرة على اعادة تسديد الضريبة في حال فسخ قرار المستأنف
