ان قانون العقوبات اللبناني وضع سنة 1943 بموجب مرسوم اشتراعي رقم 340 صادر بتاريخ 131943، مصدره قانون العقوبات الفرنسي الصادر سنة 1810 المنتمي إلى عائلة القانون الروماني والقانون العثماني الصادر سنة 1840، ومنذ تاريخ صدوره أي منذ 73 سنة، لم يخضع لعدد كبير من التعديلات، وهو بالتالي لم يتطور بصورة تجاري التطور الاجتماعي السريع لا سيما في السنوات العشرون السابقة
