باطلاع اللجنة على المخالفة الموضحة تفاصيلها أعلاه ، تبين لها أن النظر فيها يندرج ضمن اختصاصاتها المحددة قانوناً ، وحيث قضت الفقرة 14/37 من قانون الاتصالات بأنه : " يعد مخالفاً لاحكام هذا القانون ، كل مشغل أو شخص ذي صفة طبيعة أو اعتبارية يقوم بأحد الاعمال الآتية : 14- إلحاق ضرر بشبكات الاتصالات وتقنية المعلومات العامة ، أو التعدي عليها أو قطعها أو الاستفادة غير المشروعة منها أو تعطيل الاتصالات أو منع تبادل المعلومات بشكل عام " وحيث تبين من محضر الضبط المشار إليه أعلاه قيام الشركة بقطع الكيبل محل المخالفة وقيامها بأعمال الحفر دون الحصول على ترخيص من الجهة المختصة
