وينبغي دوماً بالتعليمات الا تضيف شيئا ًجديداً الى القانون أو النظام اي المنظومة القانونية اذ تكتسب عندئذ تلك الاحكام الصفة التنظيمية، ويجوز الدفع بعدم مشروعيتها في اي وقت وبعد انقضاء المهلة القانونية، فيما لو مسّت بأوضاع الافراد القانونية والمادية.
