- عدم قيام العامل بالعمل وعدم مزاولته أي عمل لدى الجهة المدعى عليها ينفي العلاقة العمالية بين الطرفين، يخرج المنازعة عن الاختصاص النوعي للهيئات العمالية، ويستوجب الحكم بعدم اختصاصها بنظر المنازعة المطروحة أمامها.
