في حال موافقة الطرف الأول للطرف الث

في حال موافقة الطرف الأول للطرف الثاني على شيء من التصرفات المشروطة بموافقة الطرف الأول كإنشاء مباني وترميمها وغير ذلك فإن الطرف الثاني يلتزم بتحمل أي مصروفات تترتب على ذلك كما يلتزم بالحصول على التراخيص اللازمة على نفقته الخاصة وبمراعاة الاشتراطات الفنية وتعليمات الجهات والبلديات المختصة وما تصدره من تصاريح وكذلك حقوق الارتفاق المقررة لمصلحة الملاك الآخرين المجاورين وفي حال مخالفة الطرف الثاني لأي شيء من ذلك فإنه يتحمل مسؤولية تلك المخالفة وما ترتب عليها تجاه الطرف الأول والغير ويحق للطرف الأول المطالبة بالتعويضات اللازمة مع عدم الإخلال بحق الجهات الرسمية أو الغير في اتخاذ جميع الإجراءات المناسبة للمحافظة على حقوقهم تجاه الطرف الثاني وللطرف الأول الاعتراض على كل ما من شأنه إنقاص قيمة الملكية أو تعريضه للهلاك أو العيب وله أن يتخذ كافة الإجراءات التحفظية الممكنة بما يضمن سلامة حقه وله الرجوع للطرف الثاني بنفقات تلك الاجراءات
