ذكرت المدعي عليها ان العائد الوارد في نشرة الاصدار عائد متوقع و ليس بالضرورة تحقيقه فعليا، لكنها تناست ان تقدير هذه العوائد لم يكن تقديرًا جزافيًا، و انما هي مبنية على معلومات و معطيات تضمنتها نشرة الاصدار و تحملت المدعي عليها المسؤولية عن دقتها، ام ان هدف المدعي عليها كان تضليل و تضخيم هذه النسبة لغرض جذب المستثمرين، ثم التنصل منها بعد ذلك؟! ثم ان المدعي عليها لم تحدد ما هي المخاطر التي اشارت إليها في نشرة الاصدار و كانت السبب في انخفاض عوائد الصندوق
