إذا اعتبرت مقام لجنة الفصل في المنازعات التابعة لهيئة سوق المال أو أي هيئة شرعيه بديلة أية أحكام واردة في هذه الاتفاقية باطلة أو أصبحت هذه الأحكام باطلة، يتم حينها فصل و استثناء تلك البنود من الاتفاقية، ولن يؤثر ذلك على بقية الأحكام الصحيحة والواردة في العقد، ويستمر العمل وتطبيق الاتفاقية وجميع بنودها الصحيحة والتي لم يرد فيها أي حكم بالبطلان، ويتم استبدال أية أحكام باطلة بأحكام جديدة لا يشوبها البطلان وتعطي إلى أبعد حد ممكن نفس النتائج المتوخاة من الأحكام التي اعتبرت باطلة. وبناءاً على ما ورد، وفي كل الأحوال سيتم فصل النصوص الباطلة للحفاظ على نظامية العقد ما لم يتعارض ذلك مع النظام العام.
