يجوز للمستأنف التنازل عن الاستئناف

يجوز للمستأنف التنازل عن الاستئناف المقام منه أمام الهيئة العليا؛ لأنه في حكم المدعي, وهو من له حق التنازل عن دعواه, ويترتب على التنازل انتهاء الخصومة في الاستئناف, ونهائية القرار الابتدائي.
