يستحق العامل أجره عن أيام الإجازة المستحقة إذا ترك العمل قبل تمتعه بها وذلك بالنسبة للمدة التي لم يحصل على إجازته عنها ، كما يستحق أجر الإجازة عن كسـور السنة بنسبة ما قضاه منها في العمل ، ويتخذ آخر أجر كان يتقاضاه العامل أساساً لاحتساب مقابل أجر هذه الإجازات .
