وبما ان مديرية الواردات بررت تكليفها الشركة بغرامة المادة 115 على الفروقات الضريبية الناتجة عن التعديلات التي تناولت اعمال العامين 2009 و2010، بما ورد في الفقرة 3 من تعليمات وزير المالية رقم 1670/ص1 تاريخ 16/6/2009 التي نصت على أنه في حال كانت تصاريح المكلف العائدة للباب الاول او الباب الثاني أو الباب الثالث متطابقة مع القيود الواردة في سجلات المكلف فان اي تعديل تجريه الادارة الضريبية على تلك التصاريح يستوجب فرض غرامة المادتين 110 و115 باعتبار أن النقص في المطرح الضريبي المصرّح عنه يترافق مع نقص في تدوين العمليات المتعلقة بذلك المطرح في سجلات المكلف.
