عندما يكون البرنامج غير متاح أو غير مؤهل للعمل بسبب أي عطل أو لأي سبب آخر، يتوجب على العميل في حال رغبته طلب تنفيذ أمر ما أن يتقدم بذلك إلى أحد مراكز الشركة الاستثمارية. سيكون للشركة أن تقبل أو ترفض وفق مطلق تقديرها أية اتصالات تصل من العميل إلى الشركة من غير ذلك. يضمن العميل في حال قبول الشركة لتلك التعليمات من خلال أي وسيلة التعويض الكامل للشركة عن أية خسائر أو أضرار تنشأ من ذلك ما لم تكن تلك الخسائر والأضرار قد نتجت عن الإهمال الكلى أو سوء التصرف المتعمد من جانب الشركة. ليس فيما تقدم بأي حال من الأحوال ترتيب أي مسئولية على الشركة إذا ما قررت وفق مطلق تقديرها عدم قبول أي اتصالات من العميل من خلال أي وسيلة اتصال عدا شبكة الإنترنت.
