يحق لكل من صاحب العمل و العامل ان يفسخ في كل حين عقد الاستخدام المعقود بينهما لمدة غير معينة... على انه في حالة الاساءة او التجاوز في استعمال هذا الحق، يحق للفريق المتضرر ان يطالب بتعويض، فإذا كان الفسخ صادرًا من قبل صاحب العمل فيُلزم هذا الاخير بتعويض يتراوح بين اجرة شهرين و 12 شهرًا
