الأصل أن التنازل عن الكفالة حق لصاحب العمل, يستعمله بمحض سلطته ما لم يتضمن عقد العمل ما يلزمه بذلك, أو يرد على الطلب اعتبارات إنسانية أو دينية تقدرها الهيئات العمالية أو الجهة المختصة رعاية للمصلحة ودفعاً للمفسدة.
