فإذا صدر قرار الهيئة الابتدائية في الحالات التي يكون قرارها ابتدائياً ورغب أحد طرفي النزع أو كلاهما الاعتراض على القرار وجب على المعترض تقديم طلب الاستئناف إلى الهيئة الابتدائية التي أصدرت القرار خلال ثلاثين يوماً من تاريخ نطق القرار في القرارات الحضورية ومن تاريخ التبليغ بالقرار الغيابي,
