قد بدأ القانون يتكون كما يقول علماء القانون مع تكون الاسرة في العصور الاولي ، ثم تطور بتكون القبيلة ، ثم تطور بتكون الدولة ، ثم بدأت المرحلة الاخيرة من التطور في اعقاب القرن الثامن عشر ، وعلي هدي النظريات الفلسفية والاجتماعية ، فتطور القانون الوضعي من ذلك الوقت حتي الان تطوراً عظيماً ، واصبح قائما علي نظريات ومبادئ لم يكن لها وجود في العصور السابقة
