أولا : المصريين المسلمين:

الطلاق عند المسلمين حق خالص للزوج يستقل بإيقاعه وبإرادته المنفردة سواء بنفسه أو بالتوكيل عنه، ولكنه لا يجب عليه استعمال هذا الحق إلا إذا استحكم الخلاف بين الزوجين وتعذرت العشرة بينهما، كما أن للزوج أن يفوض زوجته بموجب وثيقة رسمية أو في عقد زواجهما فى الطلاق، وهذا التفويض لا يلغى حق الزوج الأصلي فى إيقاع الطلاق .

• ويقع الطلاق باستعمال لفظ الطلاق صراحة أو بألفاظ أخرى قاطعة الدلالة على الطلاق كأن يقول ” أنت محرمة على ” .

• ولا يقع طلاق المجنون والمعتوه ، كما لا يقع طلاق الغضبان والسكران والمكره .

• ويقع طلاق الهازل اذ لا هزل فى الطلاق .

• مجرد القاء الزوج لصيغة الطلاق كافية لحدوثه، الا أنه عند توثيق الطلاق يتعين الاشهاد عليه ( بحضور شاهدين ) ، وعلى الزوج أن يذكر الصيغة التى تم بها الطلاق لتحديد نوعه من رجعى أو بائن، ونوع البينونة حتى يتم اثبات ذلك فى الاشهاد ودون أى تغيير بها .

مباشرة اجراءات الطلاق :

– لا تقوم القنصلية باجراء الطلاق غيابيا، ولابد لإتمام إجراءات اشهاد الطلاق بالقنصلية من حضور الزوجين ، ويجب وجود أصل وثيقة الزواج المصرية، ولا تقبل صورتها كمستند لإتمام إجراءات الطلاق.

– وفي حالة وجود الزوجة بمصر ورغبة الزوج في طلاق الزوجة غيابيا يقوم بعمل توكيل رسمي مصدق عليه من القنصلية لأحد أقاربه في مصر لإتمام إجراءات الطلاق.

– اذا حضر الزوجان وأصرا على ايقاع الطلاق، أو قررا أن الطلاق قد وقع بالفعل، يتم توثيق الطلاق بعد الاشهاد عليه.

– اذا حضر الزوجان وقررا أن الطلاق لم يقع بعد ، وأبدى الزوج رغبته فى ايقاعه ولم تصر الزوجة ، أو أبدت الزوجة رغبتها فى تطليق نفسها بمقتضى حق ثابت لها بوثيقة رسمية ولم يصر الزوج ، يتم اختيار حكم من أهله وحكم من أهلها للتوفيق بينهما خلال أجل يتفق عليه يجوز مده الى أجل أو اجال أخرى . واذا عجز الحكمان يتم توثيق الطلاق بعد الاشهاد عليه.

– يتم تحديد ميعاد مسبقا مع القنصلية لإتمام إجراءات الطلاق.

المستندات والرسوم:

• لإتمام إجراءات الطلاق بالقنصلية يلزم وجود كلا الزوجين معا ومعهما المستندات التالية :

1. اصل وثيقة الزواج المصرية.

2. جوازات السفر المصرية للزوجين.

3. جوازات سفر الشهود .

يتم إصدار وثيقة الطلاق من عدد 4 نسخ تسلم نسخة للزوج ، وتسلم نسخة للزوجة ، وترسل نسخة لمصلحة الأحوال المدنية بالقاهرة لتسجيل واقعة الطلاق بوزارة الداخلية والرجوع إليها مستقبلا عند الحاجة.

رسوم إشهاد الطلاق هو مبلغ 100 دولار نقدا أو بشيك مقبول الدفع Money Order بأسم السفارة.

كما يمكن التصديق على أحكام الطلاق الصادرة من المحاكم الأجنبية بعد تصديق صاحب الشأن عليها من السلطات المحلية الأجنبية ( الخارجية الأمريكية ) .

ورسوم التصديق على توقيع السلطات المحلية على أحكام الطلاق هو 25 دولار .

ثانيا : المصريين المسيحيين :

لا تقوم القنصلية بتطليق المصريين المسيحيين بالخارج حيث أن حالات الزواج والانفصال بين المصريين المسيحيين تتم من خلال الكنيسة المختصة ، وينظمها القانون المدني المحلى وتعاليم الدين المسيحي ، ويتم التطليق باستصدار أحد الزوجين حكما قضائيا بذلك .

يمكن للقنصلية فقط أن تقوم بالتصديق علي أحكام الطلاق الصادرة من محاكم مصرية بعد قيام صاحب الشأن بالتصديق عليها من وزارة العدل ثم الخارجية المصرية، أو التصديق على الأحكام الصادرة من المحاكم الأجنبية بعد التصديق عليها من السلطات المحلية ( وزارة الخارجية الأجنبية ) .

it can ratify the provisions of divorce issued by foreign courts after ratification by the party concerned by the foreign local authorities (US State).

Second: Egyptian Christians:

can the Consulate only to ratify the provisions of divorce issued by the Egyptian courts after the owner regard to ratification of the Ministry of Justice and the Egyptian Foreign Ministry, or the ratification of the judgments of foreign courts after ratification by local authorities (Foreign Ministry of Foreign affairs).
